Before your payment can be processed, you must accept the following terms and conditions:
By using the NZ Migration online payment service you have agreed to accept the terms and conditions applying at the time you complete the transaction.
The service available through this website is provided by Westpac New Zealand and Payment Express in agreement with NZ Migration Limited. You do not have to be a Westpac customer to use this service.
Any fees or charges applied on top of this transaction is carried out in terms of the arrangement between your card issuer and yourself. It is your responsibility to ascertain what if any fees there are as applied by your bank and/or card issuer.
If payment is made using a credit/debit card issued outside New Zealand, any currency conversion will be done according to the terms and conditions of the card and there may be additional fees charged by your card issuer.
Payment Made To NZ Migration
NZ Migration will receive only transactional data relating to payments made directly through our online service providers. If your payment is not successfully processed due to credit/debit card or other issues, your payment liability to NZ Migration will remain outstanding. If your payment liability remains outstanding you may be subject to penalties, interest and other charges. Fulfillment of your payment obligations are your sole responsibility.
If you select an amount to be paid to NZ Migration and this payment is accepted but it is later found that the amount paid is insufficient you remain liable to NZ Migration for the balance.
Payment Cannot Be Changed
You must carefully check all information you input into the NZ Migration online payment service, to ensure it is correct before you confirm the transaction can proceed. You will not be able to change it once it has been submitted.
Westpac, Payment Express and/or NZ Migration will have no liability for transactions that are incorrect as a result of inaccurate information provided by you or for any loss of information caused by factors outside of the control of Westpac, Payment Express and/or NZ Migration. This includes any information supplied by you as part of an application to NZ Migration.
Refunds, if any, will be at the entire discretion of NZ Migration and will be made as NZ Migration determines. Any refunds made will be for the invoice amount and will not include any transaction fees as applied to the processing of the payment via online service providers.
Should your delinquency exceed 30 days on invoices relating to stages other than stage 1 of your agreement we reserve the right to refer your debt to a collection agency or take other such actions as we deem necessary in the recovery of the monies.
We also reserve the right to recover those costs associated with recovering such overdue monies; which start at an additional 25% of the outstanding balance of the overdue invoice on debt registration and are increased by any costs we have incurred in our endeavors to collect overdue monies.
Once a debt is beyond 30 days delinquent you agree to pay 10% APR on monies overdue for as long as they are overdue, this can be levied daily, as well as a minimum of $30 per email/letter in communication regarding this matter that we or proxies send.
If you have a user account for NZ Migration, you are entirely responsible for maintaining the security of your login ID and password and for all activity that occurs on or through your account. You must change your password immediately if you believe that your login ID and password have been used without authorization and you must advise NZ Migration of this. NZ Migration will not have any liability for any unauthorized use of your account nor of your failure to comply with these obligations.
Any personal information you input into this website is collected by Westpac, Payment Express and NZ Migration to enable your payment transaction to NZ Migration to be completed. It will be held by Westpac and Payment Express as a record of the transaction and may also be used by Westpac and Payment Express to create a statistical picture for Westpac, Payment Express and NZ Migration of the NZ Migration clients using this service.
Westpac, Payment Express and NZ Migration will take steps to ensure your personal information is held securely. You may, in accordance with the New Zealand Privacy Act 1993, request access to, and correction of, all personal information held by Westpac/Payment Express by contacting the Westpac/Payment Express officer. Westpac, Payment Express and NZ Migration make no warranty, express or implied, and do not assume any legal responsibility:
- That the website or the server are free from computer viruses or any other harmful components, defects or errors
- That any defects in the website can be corrected
- That your access to the website will be reliable, without interruption, deletions, defects, computer viruses or communication line failures
- For any theft, destruction, damage or unauthorized access to your computer system or network
New Zealand Law
The NZ Migration online payment service is governed by New Zealand law, and the New Zealand Courts have exclusive jurisdiction in relation to it. The NZ Migration online payment service has been prepared in accordance with New Zealand law. If you access the NZ Migration online payment service from outside New Zealand, you do so at your own risk and are responsible for ensuring compliance with the all the laws in the place where you are located.
Right to Suspend, Alter or Cancel Service
NZ Migration will be entitled at any time and without prior notice to you to suspend, alter or cancel the online payment service.
